03/25/2024 – There is no federal “red flag” law but that didn’t stop the U.S. Justice Department from launching the new National Extreme Risk Protection Order Resource Center over the weekend.
The Center was announced on Saturday in conjunction with the Johns Hopkins Bloomberg School of Public Health, the latter of which earned its “Bloomberg” in 2001 following nearly $3 billion in donations from gun control advocate Michael Bloomberg. Funded by a DOJ grant, a public-facing website developed for the center offers an easy-to-use interface to help those curious navigate the process to obtain a “red flag” gun seizure order in 21 states and the District of Columbia, typically within two or three clicks from the homepage.
Going past the website, the Center also offers to “provide training and technical assistance to law enforcement officials, prosecutors, attorneys, judges, clinicians, victim service and social service providers, community organizations, and behavioral health professionals responsible for implementing laws designed to keep guns out of the hands of people who pose a threat to themselves or others.”
The Center was teased by Vice President Kamala Harris the day before the DOJ’s announcement while Harris was at a speaking event in Florida with the White House at the same time chiding that, “The 29 states without red flag laws should enact those laws and ensure effective implementation.”
Of note, Harris also stumped in her Florida speech for universal background checks and a federal ban on “assault weapons.”
The center went live just as President Biden signed the $1.2 trillion funding package of federal spending bills.
While national gun control groups applauded both the Vice President’s speech and the new red flag center, some pro-gun lawmakers on Capitol Hill were shocked by the move by DOJ.
“What the hell is this evil?” said U.S. Rep. Thomas Massie, R-Ky. “A Federal Red Flag center; We did not authorize this. Announced, of course, just hours after the omnibus passes.”
Massie was joined by U.S. Rep. Matt Gaetz, R-Fla., who said that “The Biden DOJ’s plan for a federal Red Flag Center is a direct threat to the Second Amendment and liberty as we know it. They’re going to use it to target law-abiding Americans and veterans. Members of Congress who voted for the Swamp’s Omnibus this week are responsible for funding it.”
Pro-Second Amendment groups argue that red flag laws typically have little to no effect on crime, are inherently discriminatory against the poor because subjects usually have to pay for an expensive legal defense to get their gun rights restored, and stigmatize mental illness without a mandate of providing health resources to those impacted by such orders.
